VILLAGE OF WESTBURY
Notice is hereby given that a public hearing will be held by the Board of Appeals of the Inc. Village of Westbury, for hearing of appeals from orders of the Senior Building Inspector for matters as may be heard on Monday December 15, 2025, at 7:30 p.m., at the Village Hall, 235 Lincoln Place, Westbury, NY 11590. Interested parties may view the application and associated materials at any time between the hours of 9:00 a.m. and 4:30 p.m., at the Clerk’s Office, 235 Lincoln Place, Westbury, NY 11590. At the hearing, all interested persons will be given an opportunity to be heard.
Application 2025-12-01 of Heather Sanderson, seeks to legalize and maintain two family dwelling at the property known as 59 Central Avenue, Westbury, NY 11590, which is in violation of Village Code § 248-35 (Lot Size): “no two-family dwelling shall be constructed on a lot of an area less than 7,500 square feet, unless authorized by the Board of Appeals pursuant to Article XXXVI, § 248-326A.” (Required 7,500 sf, Proposed 5,067 sf); § 248-36.1 (Area of two-family dwelling): “The building area of a two-family dwelling shall not exceed 25% of the lot area.” (Max allowed 25%, Proposed 32.4%); § 248-39.1 (Side yards of two-family dwelling): “In the case of a two-family dwelling, there shall be two side yards, one on each side of the main dwelling, the aggregate width of which shall be at least 30 feet. Neither side yard shall be less than 10 feet.” (Min required: 10’ single/ 30’ aggregate, Proposed: 5.7 single/ 15.5’ aggregate); § 248-45B (Lot width and frontage): “No building shall be constructed on a lot having a width and a frontage of less than 75 feet where a minimum lot area of 7,500 square feet is required…” (Min lot width: 75’, Proposed: 50.67’). The subject property is identified on the Nassau County Tax Map as Section 10, Block 286, Lot 31, Zone: Residence C.
Application 2025-12-02 of Luigi Gileno, seeks to legalize and maintain one story addition, finished basement and roof overhang at the property known as 37 Manhattan Avenue, Westbury, New York 11590, which is in violation of Village Code § 248-38 (Rear yard): “There shall be a rear yard depth of which shall not be less than 25 feet.” (Min required 25’, Proposed 20.7’); § 248-39 (Side yards): “In the case of a single-family dwelling, there shall be two side yards, one on each side of the main dwelling, the aggregate width of which shall be at least 13 feet. Neither side yard shall be less than five feet wide…” (Min required: 5’ single/13’ aggregate, Proposed .5’ (6 inches)/ 5.3’ aggregate). The subject property is identified on the Nassau County Tax Map as Section 10, Block 11, Lot 28, Zone: Residence C
Application 2025-12-03 of Howard Curtis, seeks to construct 2 side additions, front porch, and roof over patio at the property known as 54 Walsh Lane, Westbury, NY 11590, which is in violation of Village Code § 248-8 (Area): “The building area shall not exceed 20% of the lot area.” (Max Allowed: 20% lot coverage, Proposed: 29.59%); § 248-9 (Front Yard): “There shall be a front yard, the depth of which shall not be less than 30 feet.” (Min required: 30’, Proposed: 25.1’); § 248-10 (Rear Yard): “There shall be a rear yard the depth of which shall not be less than 30 feet.” (Min: 30’, Proposed: 17.42’); and § 248-11 (Side Yards): “In the case of a single-family dwelling, there shall be two side yards, one on each side of the main building, the aggregate widths of which shall be at least 30 feet. Neither side yard shall be less than 12 feet wide…” (Required: 12’ single, 30’ aggregate, Proposed 6.8’/22.9’ aggregate).
